Selling a Home After the Owner Has Passed: What to Know

When a property is part of an estate, selling it takes a few extra steps — and a little more patience.

Even if a family member is ready to sell, they can’t move forward unless they have legal authority to do so. That usually means going through probate or having clear documents in place like a will or trust.

And just because someone signs a listing agreement doesn’t mean they can legally transfer ownership. It’s one of the first things we verify when estate sales come across our desk.

These closings often require additional paperwork — like death certificates or court documents — so it’s smart to give yourself a little extra time. The earlier we know it’s an estate, the more we can do to keep things on track.
